Please review the following Terms of Use (“Term”) carefully before signing up with myimagezone (herein referred to as “we”, “us”, or “myimagezone”) to use our service (“Service”).  This agreement (“Agreement”) becomes effective when you click the “Signup” button.  Myimagezone reserves the right to change these Terms from time to time.  Any modification is effective immediately.

1.    Submissions & Transmission

You may not place/transmit or permit others to place/transmit any of the following material or obtain any such material using the Service:

a.    Any material that could infringe rights of privacy copyrights without the permission of the copyright owner.

b.    Any obscene, pornographic, profane or threatening materials that could give rise to any civil or criminal liability under applicable law.

c.     Any material that could violate any law, rule, or regulations of any governmental or other administrative organization having authority over the Service, myimagezone, or Users.

While myimagezone does not and cannot review all submissions, and is not responsible for their content, myimagezone reserves the right to delete, move or edit contents that are, in its sole discretion, in violations of these rules.  You acknowledge that any submission or user content may be removed, published, copied, modified, transmitted and displayed by myimagezone for the purposes of delivering the offered services.

2.    Personal Information

You herby certify that you are not a minor.  A minor’s parent or legal guardian may authorize a minor to use his/her account under supervision by the parent guardian.

3.    Fees

All charges incurred for use of the Service will be paid at the time the products or services are purchased.  If at any time a credit card charge, or payment check is refused, myimagezone may, at its sole discretion, immediately suspend or terminate this Agreement, but User will still be responsible for all charges incurred.  If any payment due is not made by the User, myimagezone may, in addition to its other remedies, at its sole discretion and without notice to the User, (a) suspend its performance under this Agreement and User’s access to and use of the Service, or (b) terminate this Agreement and User’s access to and use of the Service.

4.    Image backup and archiving

The service is not designed or intended to be used as a disaster recovery facility or as an emergency data storage facility.  Although myimagezone takes reasonable precautions to preserve and protect the uploaded materials, you should not reply on the Service as your only source for the material you provide.

5.    Disclaimer of warranties; Limitation of Liability

User acknowledges that use of the Service is at User's sole risk.  The Service is not warranted to be error free or uninterrupted, and there is no warranty as to the results obtained through use of the Service. The Service is made available on an “AS IS” and “AS AVAILABLE” basis.  myimagezone may, at its discretion, but shall not be obligated to, provide support for the Service and related myimagezone software and tools. THERE ARE NO WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE WITH RESPECT TO THE SERVICE.  Neither myimagezone nor anyone else involved in creating, producing, or delivering the Service, or any services accessible through the Service, will be liable for any direct, incidental, special or consequential damages arising out of this Agreement.  In no event will the liability of myimagezone for any breach of this Agreement exceed the total charges incurred by a User in the month preceding the date the claim for breach arose.  The provisions of this Section will survive termination of this Agreement.

6.    Termination

a.    You may terminate your account at any time.  You must notify myimagezone by sending email to support@myimagezone.com.  After receipt of your termination notice, myimagezone will terminate your account.

b.    Myimagezone may terminate your account at any time in the event of a breach of this Agreement by User or anyone accessing the Service using User’s account.  Myimagezone, at its sole discretion, may also terminate this Agreement at any time without cause, and may suspend access to the Service with or without notice, to any User.

c.     Termination or suspension of an account does not relieve you of any obligations you have accrued, including payment of any charges due in connection with your account.  You are responsible for payment of all such charges.
